Distance Sales Contract

1. PARTIES
This Agreement has been signed between the parties under the following conditions:

  1. "CUSTOMER NAME - SURNAME" (hereinafter referred to as "BUYER")
  2. JACEYJACE TEXTILE CONST. IND. AND TRADE CO. LTD. (hereinafter referred to as "SELLER").
    By accepting this contract, the BUYER accepts that he/she will fulfill the payment obligation of additional fees such as order price, shipping fee and tax, if any, when he/she confirms the order and that he/she has been informed about this.

2. DEFINITIONS
In the application and interpretation of this agreement, the following terms have the meanings opposite to them:

  • MINISTER: Minister of Customs and Trade
  • MINISTRY: Ministry of Customs and Trade
  • LAW: Consumer Protection Law No. 6502
  • REGULATION: Distance Contracts Regulation
  • SERVICE: Any transaction other than the provision of goods that constitutes the subject of the consumer transaction.
  • SELLER: A company that offers goods to consumers or offers goods on their behalf.
  • BUYER: Person who uses the goods or services for non-commercial purposes.
  • SITE: SELLER's website
  • ORDERER: The person who requests the product from the SELLER's website.
  • PARTIES: SELLER and BUYER
  • CONTRACT: This contract is made between SELLER and BUYER.
  • GOODS: Movable items and intangible goods prepared for use in electronic media.

3. SUBJECT
This Agreement regulates the rights and obligations of the BUYER regarding the sale and delivery of the order placed electronically through the SELLER's website.
Prices listed are sales prices and are valid until updated. Temporary prices are valid until the specified period.

6. INFORMATION ABOUT THE PRODUCT/PRODUCTS SUBJECT TO THE CONTRACT
6.1. Basic features of the products (type, quantity, brand/model, color, number) are available on the SELLER's website. If a campaign is made, the product features will be valid for the duration of the campaign.
6.2. Product prices and promises are valid until updated.
6.3. The sales price of the product, including all taxes, is stated below:

    6.4. Shipping costs will be paid by the BUYER.

7. GENERAL PROVISIONS
7.1. BUYER accepts that he/she is informed about the basic features of the product, its price and payment method and that he/she has given the necessary approval.
7.2. SELLER agrees to deliver the product subject to the contract within the specified period. The delivery period cannot exceed 30 days depending on the location of the product.
7.3. SELLER guarantees that the product will be delivered complete and in accordance with the specified qualifications.
7.4. If the order becomes impossible to fulfill, the SELLER will notify the BUYER of the situation and refund the payment within 14 days.
7.5. BUYER declares that he/she accepts the delivery and payment of the product.
7.6. The BUYER must inspect the product subject to the contract before delivery and must not accept the product in case of any damage.

8. RIGHT OF WITHDRAWAL
8.1. The BUYER may exercise his right of withdrawal without giving any reason within 14 days from the delivery of the product.
8.2. To exercise the right of withdrawal, the product must be unused and its packaging must be intact.
8.3. For a return, the BUYER must return the product within 14 days along with the return form and invoice.

9. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
The following products are not subject to the right of withdrawal:

  • Underwear products
  • Make-up products
  • Digital contents and software programs
  • Opened products

10. EVENT OF DEFAULT AND ITS LEGAL CONSEQUENCES
If the BUYER makes the payment by credit card, he/she will be liable to the bank in case of default.

11. COMPETENT COURT
Disputes arising from this contract will be resolved in the consumer court in the BUYER's place of residence.

12. ENFORCEMENT
By completing his order on the website, the BUYER is deemed to have accepted all the terms of this agreement.
